Contract Law - Consideration; Pre-existing duty?
Does anyone know why the judge did not use the precedent set in Stilk v Myrick (1809) 2 Camp 317 and instead opted for a more commercialised judgement in Williams v Roffey Bros & Nicholls (1991) 1 QB 1.
Why did the court justify the need to obviate from the precedent set 200 years ago and extend the criteria of consideration to include "practical benefit".
In Stilk v Myrick, the duties of the seamen had not radically changed by losing 2 crewmen who left the ship. Nothing much had changed, and that is why they were not entitled to claim more money. Can you claim more wages if one or two people phone in sick?
In Williams v Roffey, an ongoing rolling contract scenario for building work, with changing costs for materials, and ongoing payments in installments, makes it a different matter, with both parties in a position to constantly negotiate. If you were a builder being paid in installments, and buying materials as you go along, what do you do if you agreed a fixed price, but the costs of your materials rises?
Consideration need not be something of a material value. "Weighing boilers" has been deemed sufficient in the past! The judgment in Williams says that the particular contract was suited varying terms because the nature of the contract was variable.
